By booking a space, purchasing a membership, or entering Book’D premises, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, the Rental/License Agreement, Liability Waiver, all policies referenced herein, and any amendments thereto. Your continued use of Book’D services constitutes ongoing acceptance of these terms.
Acceptance of Terms
Nature of Agreement
LICENSE, NOT LEASE: All bookings at Book’D constitute a temporary, revocable license to use the designated space during the reserved time period. This arrangement does NOT create a landlord-tenant relationship, and renters have no rights under Illinois landlord-tenant law, including but not limited to rights of possession, notice periods, or eviction protections.
INDEPENDENT CONTRACTOR STATUS: All renters operate as independent contractors. Book’D does not employ renters, control their services, set their prices, or share in their revenues. Renters are solely responsible for their business operations, tax obligations, and regulatory compliance.
Eligibility Requirements
- Must be at least 18 years of age
- Must hold valid professional license(s) required by Illinois law for services provided
- Must maintain professional liability insurance meeting Book’D requirements
- Must have valid payment method on file
- Must agree to all Book’D policies and procedures
Renter Representations & Warranties
By using Book’D services, you represent and warrant that:
- All information provided to Book’D is accurate, current, and complete.
- You possess all licenses, permits, and certifications required for the services you provide.
- Your professional liability insurance is current and meets minimum requirements.
- You will comply with all applicable federal, state, and local laws and regulations.
- You will comply with Illinois Department of Financial and Professional Regulation (IDFPR) standards.
- You will comply with all health and sanitation codes applicable to your profession.
Booking & Payment Terms
- Prepayment Required: All bookings must be paid in full at time of reservation.
- Minimum Booking: 2 hours for suites/stations; varies by package for podcast studio.
- Accepted Payment: Credit/debit cards, ACH transfers via Stripe.
- Taxes: All applicable taxes will be added to quoted rates.
Prohibited Activities
The following activities are strictly prohibited at Book’D:
- Providing unlicensed services or practicing outside the scope of licensure
- Subletting, subleasing, or transferring booking rights to third parties
- Use of spaces for illegal activities of any kind
- Smoking, vaping, use of illegal drugs, or alcohol consumption
- Harassment, discrimination, or threatening behavior toward any person
- Damaging, defacing, or removing Book’D property
- Sharing access codes or allowing unauthorized persons to enter
- Initiating chargebacks or disputing legitimate charges
- Any activity that creates a nuisance or disrupts other renters
Intellectual Property
Book’D, the Book’D logo, “Your Business. Your Time. Your Space.”, and all related trademarks are the property of Book’D LLC. Renters may not use Book’D branding without prior written consent. Content created by renters at Book’D (photos, videos, podcasts) remains the property of the renter; however, renters grant Book’D a non-exclusive, royalty-free license to use images and videos of the premises for marketing purposes.
Dispute Resolution
- Informal Resolution: Parties agree to attempt good-faith resolution of any dispute before pursuing formal remedies.
- Governing Law: These Terms shall be governed by the laws of the State of Illinois.
- Venue: Any legal action shall be brought exclusively in the courts of Cook County, Illinois.
- No Chargebacks: Renters agree not to initiate chargebacks and to resolve payment disputes directly with Book’D.
Limitation of Liability
To the maximum extent permitted by law, book’d llc, its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to these terms or use of book’d services, regardless of the theory of liability. Book’d’s total liability for any claim shall not exceed the amount paid by the renter for the specific booking giving rise to the claim.
Amendments
Book’D reserves the right to modify these Terms of Service at any time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of Book’D services after the effective date constitutes acceptance of modified terms.
