Assumption of Risk

Licensee acknowledges that the use of Book’D facilities and the provision of professional services involves inherent risks, including but not limited to: risks of injury to Licensee, clients, or guests; risks of property damage or loss; risks of claims arising from professional services; and risks associated with the conduct of third parties. Licensee voluntarily assumes all such risks.

Release of Liability

To the fullest extent permitted by law, Licensee hereby releases, discharges, and holds harmless Book’D LLC, its owners, officers, directors, members, managers, employees, agents, contractors, and affiliates (collectively, “Released Parties”) from any and all claims, demands, actions, causes of action, damages, losses, costs, expenses, and liabilities of any kind, whether known or unknown, arising out of or related to: (a) Licensee’s use of Book’D facilities; (b) services provided by Licensee at Book’D; (c) the conduct of Licensee’s clients or guests; (d) any injury, illness, or death of any person; (e) any damage to or loss of property; and (f) any claims by third parties.

Indemnification

Licensee agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, causes of action, damages, losses, costs, expenses (including reasonable attorneys’ fees), and liabilities arising out of or related to: (a) Licensee’s breach of this Agreement or any Book’D policy; (b) Licensee’s negligence, willful misconduct, or violation of law; (c) services provided by Licensee; (d) the conduct of Licensee’s clients or guests; (e) any injury, illness, or death of any person caused by or related to Licensee’s activities; and (f) any third-party claims related to Licensee’s use of Book’D facilities.

Disclaimer of Warranties

Book’d provides all facilities, equipment, and services “As is” and “As available” without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Book’d does not warrant that the facilities will meet licensee’s requirements or that access will be uninterrupted or error-free.

Personal Property

Book’d is not responsible for any personal property left at the premises. Licensee acknowledges that book’d does not provide insurance coverage for licensee’s tools, products, equipment, or personal belongings. Licensee is solely responsible for securing personal property and assumes all risk of loss, damage, or theft.

Survival

The provisions of this Section 8 shall survive the termination or expiration of this Agreement and any booking.
